These Terms and Conditions (“Terms”) govern your use of the services provided by Synergy Health DPC (“we,” “us,” or “our”), including our patient portal, text message communications, electronic prescribing services, and related healthcare services. By using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By enrolling as a patient, accessing our patient portal, or opting in to receive text messages, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please contact our office to discuss alternative communication arrangements.
2. Description of Services
Synergy Health DPC provides the following services:
- Direct Primary Care (DPC): Comprehensive primary care services provided on a membership basis, including office visits, telehealth consultations, and care coordination.
- Patient Portal: Secure online access to your medical records, appointment scheduling, messaging with your care team, and prescription management.
- Text Message Communications: Automated and manual text messages for appointment reminders, prescription notifications, billing alerts, and other healthcare-related communications.
- Electronic Prescribing: Prescriptions sent electronically to your pharmacy through the Surescripts network via our certified e-prescribing system.
- Telehealth Services: Virtual consultations conducted through our secure platform, including asynchronous clinical assessments and real-time video visits.
3. Text Message Terms
3.1 Consent to Receive Messages
By providing your mobile phone number, you expressly consent to receive automated and non-automated text messages (SMS/MMS) from Synergy Health DPC at the phone number you provide. Your consent is not a condition of receiving healthcare services. You may receive text messages regarding:
- Appointment reminders and confirmations
- Appointment cancellation or rescheduling notices
- Prescription status notifications
- Lab result availability alerts
- Billing and payment reminders
- General practice information and health alerts
3.2 Message Frequency and Costs
Message frequency varies. You may receive up to 15 messages per month depending on your healthcare activities. Message and data rates may apply. Check with your mobile carrier for details about your messaging plan. We are not responsible for any charges your carrier may impose.
3.3 Opting Out
You may opt out of text messages at any time by texting STOP to any message from us. You will receive a single confirmation message after opting out. You may opt back in at any time by contacting our office or texting START.
3.4 Help
For assistance, text HELP to any of our messages or call our office directly.
3.5 Supported Carriers
Our text messaging service is compatible with most major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.
3.6 Accuracy of Phone Number
You are responsible for providing and maintaining an accurate mobile phone number. If you change your phone number, please update your contact information with our office immediately to ensure you continue to receive important healthcare communications and to prevent messages from being sent to an incorrect number.
4. Patient Portal Terms
4.1 Account Security
You are responsible for maintaining the confidentiality of your patient portal login credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized access to your account due to your failure to protect your credentials.
4.2 Acceptable Use
You agree not to use the patient portal to:
- Access another person’s medical records without authorization
- Transmit malicious software or attempt to compromise system security
- Use the platform for any purpose unrelated to your healthcare
- Misrepresent your identity or provide false information
5. Electronic Prescribing
When your provider prescribes medication, prescriptions may be sent electronically to your designated pharmacy through the Surescripts network. By using our e-prescribing services, you acknowledge that:
- Your prescription information will be transmitted electronically to your chosen pharmacy.
- You are responsible for designating an accurate pharmacy and notifying us of any changes.
- Controlled substance prescriptions may require additional verification and may not be eligible for electronic prescribing in all circumstances.
- Electronic prescriptions are subject to the same laws and regulations as paper prescriptions.
6. Telehealth Services
By using our telehealth services, you acknowledge and agree that:
- Telehealth consultations are conducted remotely and have inherent limitations compared to in-person visits.
- You are responsible for being in a state where your provider is licensed to practice at the time of the consultation.
- In an emergency, you should call 911 or go to the nearest emergency room rather than using telehealth services.
- Your provider may determine that your condition requires an in-person visit and may decline to provide treatment via telehealth.
7. No Emergency Services
Our text messaging service and patient portal are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 immediately. Do not rely on text messages or the patient portal to communicate urgent or emergency medical needs.
8. Privacy and HIPAA Compliance
We are committed to protecting your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state privacy laws. Please review our Privacy Policy for detailed information about how we collect, use, and protect your information.
9. Disclaimer of Warranties
Our electronic communication services (text messaging, patient portal, e-prescribing) are provided “as is” and “as available.” While we strive for reliability, we do not guarantee that:
- Text messages will be delivered without delay
- The patient portal will be available at all times without interruption
- Electronic prescriptions will be received by your pharmacy instantaneously
Technical issues with mobile carriers, internet service providers, or pharmacy systems may cause delays. We recommend confirming receipt of important communications by contacting our office directly.
10. Limitation of Liability
To the maximum extent permitted by law, Synergy Health DPC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our text messaging service, patient portal, or other electronic communication services, including but not limited to damages resulting from delayed or undelivered messages, system outages, or unauthorized access to your account.
11. Indemnification
You agree to indemnify and hold harmless Synergy Health DPC, its officers, employees, and agents from any claims, losses, or damages arising from your misuse of our services or violation of these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, when practicable, by sending you a text message or email notification. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Mecklenburg County, North Carolina.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
