  • Communication Records: Records of text messages, appointment reminders, prescription notifications, and other communications sent to or received from you.
  • Device and Usage Information: Information about the device and browser you use to access our patient portal, including IP address, browser type, and access times.

2. How We Use Your Information

We use your information for the following purposes:

  • Healthcare Services: To provide, coordinate, and manage your healthcare, including diagnosis, treatment, and prescription management.
  • Communications: To send you appointment reminders, prescription notifications, lab result alerts, billing reminders, and other healthcare-related messages via text message (SMS/MMS), email, or phone.

3. Text Message (SMS/MMS) Communications

By providing your mobile phone number and opting in to receive text messages, you consent to receive text messages from Synergy Health DPC for the following purposes:

  • Appointment reminders and confirmations
  • Appointment cancellation and rescheduling notifications
  • Prescription ready notifications
  • Lab result availability alerts
  • Billing and payment reminders
  • General practice announcements and health information

Message Frequency

Message frequency varies based on your appointments, prescriptions, and other healthcare activities. You may receive multiple messages per week depending on your care needs.

Message and Data Rates

Message and data rates may apply. Your mobile carrier’s standard messaging rates will apply to all text messages sent to and from our service. Synergy Health DPC is not responsible for any charges incurred from your mobile carrier.

Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message. Opting out of text messages will not affect your ability to receive healthcare services or access your medical records.

Privacy of Text Messages

We take precautions to protect the content of text messages. However, SMS/MMS messages are not encrypted in transit and may be accessible by your mobile carrier or other third parties. We will not include detailed Protected Health Information in text messages. Messages will contain general reminders and alerts directing you to your secure patient portal for detailed information.

We implement administrative, technical, and physical safeguards to protect your personal and health information, including:

  • Encryption of data in transit and at rest
  • Role-based access controls for all staff
  • Regular security audits and vulnerability assessments
  • HIPAA-compliant data storage and handling procedures

5. How We Share Your Information

We may share your information in the following circumstances:

  • Treatment, Payment, and Operations: With other healthcare providers involved in your care, insurance companies for payment processing, and as needed for practice operations, as permitted by HIPAA.
  • Service Providers: With trusted third-party service providers who assist us in operating our practice, including our electronic prescribing service (for sending prescriptions to your pharmacy), SMS messaging provider, and cloud hosting provider. These providers are contractually obligated to protect your information.
  • Legal Requirements: When required by law, court order, or government regulation, or to protect the rights, safety, or property of our patients, staff, or others.
  • With Your Consent: For any other purpose with your written authorization.

We do not sell, rent, or trade your personal or health information to third parties for marketing purposes.

6. Your Rights Under HIPAA

As a patient, you have the right to:

  • Access and obtain a copy of your medical records
  • Request corrections to your medical records
  • Request restrictions on certain uses and disclosures of your information
  • Request confidential communications (e.g., to a different phone number or address)
  • Receive an accounting of disclosures of your health information
  • File a complaint if you believe your privacy rights have been violated

7. Data Retention

We retain your medical records and personal information in accordance with applicable federal and state laws. Text message records are retained for a minimum of six (6) years as required by HIPAA regulations. You may request deletion of non-essential data by contacting us.

8. Children’s Privacy

Our text messaging service is intended for individuals 18 years of age and older. For minor patients, text messages will be sent to the parent or legal guardian’s phone number on file.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website with a new effective date. Your continued use of our services after such changes constitutes your acceptance of the revised policy.
